1. Introduction & Effectiveness

This document defines the General Conditions of use of the website and the regulation of the sale of products and services offered by the company Arianna De Marco, with registered office in Florence, REA FI-662197, VAT number 06867250489, hereinafter referred to as Italy on my Table through the site www.italyonmytable.com (hereinafter referred to as the “Site” or “Platform”).

Before starting to browse the Site and proceeding to register on it, and in any case before using the services offered by Italy on my Table, we invite users to carefully read these General Conditions. Browsing, registering on the Site and using the related services constitutes express acceptance of these Conditions.

These General Conditions are applicable to any transaction completed through the Site, whether it concerns a product or service offered by third-party vendors other than Italy on Mya Table, or whether it concerns a product or service offered directly by Italy on my Table.

Italy on My Table reserves the right to update, integrate and modify all or part of these Conditions and each of the documents referred to by them. These changes will be effective from the moment of publication on the Site, regardless of the actual knowledge that the user has of them.

The user undertakes to periodically review the General Conditions, it being understood that Italy on my Table will do what is reasonably necessary and appropriate to inform the user, through the Site itself, of any changes to the Conditions.

2. The Role of “Italy on my Table”

The website www.italyonmytable.com is a platform that favors the meeting between supply and demand for handcrafted products of Tuscan origin. In particular, on the Platform you will meet:

“Sellers” or any natural or legal person, public or private who, in the exercise of their entrepreneurial or professional activity, has entered into an agreement with Italy on my Table and intends to make their goods or services available for purchase or use through the Platform;
“Buyers” or any natural or legal person, registered on the Platform, who purchases the products and services made available by the Sellers through it.
Italy on my Table promotes contact between the Sellers and the Buyers but is not part of the commercial transactions between them and has no direct control over the activity of the Sellers, the products and services offered and their quality.

By registering on the Site, Sellers and Buyers declare that they know that Italy on my Table is NOT the buyer, producer or seller of the goods and services advertised and sold, but only performs the function of facilitating relations between Sellers and Buyers, as better specified below art. 9 of these General Conditions.

By registering, the Buyer declares to know that:

a) the Sellers operate in complete autonomy;

b) all the information entered on the Site regarding the products and services offered are entered on the basis of the information provided by the Sellers;

c) the particular conditions of sale are applied by the Sellers;

d) Italy on my Table does not carry out any preventive checks on the truthfulness and correctness of the data provided by the Sellers.

3. Promotion Service

The Sellers have the opportunity to promote their business and their products and services on the Site according to the times and methods agreed through a specific agreement with Italy on my Table. For each Seller, Italy on my Table undertakes to create a Virtual Showcase with visual and textual content.

3.1 The products

All the products on sale on the Site constitute an offer to the public with the limitations and procedures contained on the Site itself and in these General Conditions.

The products are the property of the individual Sellers until the purchase price and expenses have been paid by the Buyer.

Variable weight Products (for example fruit, vegetables, meat, fish, cured meats and cheeses) are offered on the Site in guaranteed minimum sizes and weights.

3.2 The contents

The Seller undertakes to provide Italy on my Table with all the information requested and necessary for the creation of the Virtual Showcase, including data (legal, economic, historical, geographical) relating to the company and individual products, as specified in the contract. The Seller undertakes to guarantee the truthfulness and completeness of the information provided and to promptly notify Italy on Mya Table of any changes. All information will be processed by Italy on my Table in compliance with the rules of confidentiality and security provided for by Legislative Decree, 06.30.2003, n. 196 and subsequent amendments.

Italy on my Table provides the Seller with a video and photo shooting service of the company and products. The photographs and presentation videos accompanying the virtual showcase are for illustrative purposes only and may undergo changes. The Seller undertakes to ship the products that conform to the descriptions and images on the Site.

Seller and Buyer exonerate Italy on my Table from any liability in case of non-correspondence between the image published on the Site and the product delivered by the Seller.

All visual and textual materials created by the company will remain the property of the latter which retains all rights, including those of economic exploitation.

3.3 Prices
All prices indicated on the Site (final sales prices) are expressed in Euros (€) and are inclusive of VAT. The final sales prices are also inclusive of the Italy on my Table commission as specified in the contract stipulated between Italy on my Table and the Sellers.

Prices may be changed without notice until the order is confirmed. The contribution to the shipping costs of the order is explicitly indicated and is inclusive of VAT.

Italy on my Table will only apply the price calculated at the time of the order, without considering price increases or decreases, even for promotions that may have occurred subsequently or previously concluded.

Italy on my Table has the ability to set a minimum purchase order for each Seller, as per the contract stipulated between the company and the Seller.

4. Sales Service: the marketplace

The website www.italyonmytable.com is structured as a Platform that favors the meeting between Sellers and Buyers. The purchase of products and services by the Buyers is subject to the registration of a user account on the Site as well as to the sending of a purchase order and confirmation of the same, upon payment of the selected products.

4.1 Registration and Customer Account
In order to proceed with the purchase of the products, the Buyer must necessarily register on the Site and create his own account, thereby approving these General Conditions. Registration is free. To register, the Buyer must complete the appropriate registration form by entering an email address and password. Registration will be confirmed by email.

By registering, the Buyer agrees to receive newsletters and commercial offers from Italy on my Table. At any time, the Buyer may request not to receive further newsletters and commercial offers.

Registration credentials are strictly personal and must not be disclosed to third parties. The Buyer guarantees the correctness and completeness of the credentials provided at the time of registration and is responsible for all operations carried out using his credentials.

It will be possible to make only one registration per Buyer. Multiple registrations will be cancelled. Italy on my Table also reserves the right to refuse registration at its own discretion

4.2 Registration and Seller Account
The sale of products through the Site is subject to the stipulation of a contract between Italy on my Table and the Sellers and the relative activation of a Seller account. Italy on my Table also reserves the right to refuse registration at its own discretion, and to suspend the activity of the registered Seller at any time and without prior notice.

To return your product, you should mail your product to: {physical address}.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you may vary.

If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

4.3 Order Process
Once accessed to the Site, to proceed with the purchase, the Buyer must select the products he wishes to purchase, enter the payment and shipping data, following all the steps for sending the order through the Site.

Once the order has been completed on the Site, the Buyer will receive an email to the address with which he is registered on the Site with a summary of the order made, including product prices, delivery costs and the shipping address provided.

The Company reserves the right not to accept or partially refuse orders placed without compliance with these General Conditions, anomalous orders in relation to the quantity of products purchased or the frequency of purchases themselves as well as the improper use of discount coupons.

Italy on my Table reserves the right not to carry out orders that have already been accepted if it suspects that the purchase transaction is fraudulent or carried out by illegal means.

4.4 Payment
To conclude the purchase process, payment must be made. The Buyer pays for the products exclusively using the payment methods offered and accepted on the Site.

The Buyer may pay the price of the products and the relative shipping costs by credit card and Paypal. The accepted circuits are VISA, Mastercard.

The consideration will be credited by Italy on my Table, net of the agreed commission, in favor of the Seller according to the terms agreed with the latter.

Payments made with methods other than those described in this article or in direct favor of the Seller, will NOT be effective and will not allow the completion of the sale.

4.5 Order Changes
Once confirmed, it is no longer possible to make changes to the order. In case of need, the Buyer may contact the Italy on my Table customer service referred to in the following art. 11.

4.6 Non-availability of products
In the event that one or more products for sale on the Site are not available or are out of stock at the relative Seller, the same undertakes to promptly notify Italy on my Table of such shortcomings in order to prevent their purchase on the Site.

If one or more products are not available, within twelve hours of receiving the order concerning these products, the Seller must send an appropriate notification to Italy on my Table and propose at least one alternative product of the same agri-food category. The Italy on my Table customer service will promptly notify the Buyer of the non-availability of one or more products ordered and the possible availability of alternative products of the same or similar agri-food category. The Buyer will have 24 hours to confirm the shipment of any additional products available or cancel the delivery. In case of no response within this period, the order will be considered confirmed with regard to the available products and a refund will be made for the unavailable products.

4.7 Shipping
Italy on my Table offers each Seller to use an automated shipping service carried out by several couriers with which it has signed commercial agreements. Italy on my Table reserves the right to change the shipping service offered at any time.

Once the order has been received, the Seller who decides to use this shipping service must prepare the package according to the instructions provided by Italy on my Table and the courier, access their vendor account, create the shipment and print the relevant documents. The courier will then proceed to collect the package and deliver it according to the agreed and indicated times.

The delivery of the goods is carried out in the Italian territory only, to the address indicated by the Buyer at the time of the order and indicated in the order confirmation email.

Once the Seller has shipped the order, the Buyer will receive a confirmation email which will include a link to track the shipment. The Seller himself will be able to monitor the shipment via a specific link

Purchases will be delivered by express courier from Monday to Friday, excluding holidays and public holidays. The Buyer may send a notification to Italy on my Table of any breach of the transport contract.

Italy on my Table is not responsible for the correct execution of the transport contract and, therefore, is not liable for delays, loss or damage to the goods.

Italy on my Table is committed to offering competitive shipping prices for Buyers. Italy on my Table also reserves the right to charge additional shipping costs to the Seller to be defined in the contract phase or applicable in the event of incorrect use of the shipping service by the Seller.

With regard to the purchase of services, such as, by way of example but not limited to, food and wine tours and cooking lessons, the Buyer will receive, at the email address with which he made the purchase, a voucher with the terms and conditions relating to the service itself.

4.8 Billing
If the Buyer is a professional or an entrepreneur, it will be possible to request the issue of an invoice when placing the order. The Purchaser must provide billing information including name and/or denomination, address of the registered office, tax code and/or VAT number. The Buyer is responsible for the correctness of the billing data provided and is informed that it will not be possible to issue invoices that have not been requested in the order phase. The invoice will be issued directly by the Seller.

5. Discount Coupons

Italy on my Table grants, at its discretion, the opportunity for Buyers to take advantage of discount coupons. Discount coupons may be granted, by way of example but not limited to, following the Buyer’s registration or on the occasion of specific promotional events.

The value, expiry date and any further conditions of use of the vouchers are indicated at the time of issue. Vouchers are not transferable or transferable and cannot be exchanged for cash. Vouchers cannot be used to pay for shipping costs. Once used, the vouchers cannot be refunded

In the event that the amount of the vouchers is higher than that of the purchase, the difference cannot be refunded. In the event that the purchase amount is higher than that of the voucher, the Buyer must pay the rest of the amount using the payment methods offered by the Site.

Italy on my Table reserves the right to revoke the vouchers in case of fraudulent activity or irregular use of the same.

6. Right of Withdrawal

6.1 Right of withdrawal – Purchase Products
The Buyer who has purchased products through the Site has the right to withdraw from the contract with the Seller, without any penalty and without specifying the reason, within 14 working days from the date of receipt of the goods, unless otherwise specified.

Pursuant to art. 59, paragraph 1, lett. c), d) and e) of the Legislative Decree, 06.09.2005, n. 206 (Consumer Code) the right of withdrawal is excluded in relation to:

the. goods made to measure or clearly personalized;

ii. goods that are liable to deteriorate or expire rapidly; And

iii. sealed goods which do not lend themselves to being returned for hygienic or health protection reasons and which have been opened after delivery.

With reference to the cases of exclusion of the right of withdrawal listed above, the Buyer, in particular, is informed and accepts that the Products that “risk to deteriorate or expire rapidly” include all food products. For this reason, this right is applicable only to products that can be returned intact to the Seller and then put back on the market.

The Buyer may exercise the right of withdrawal, pursuant to art. 52 et seq. of the Consumer Code, in relation to specific Products, other than those listed above, provided that these, after delivery, have not been opened or their seals altered. The substantial integrity of the product to be returned constitutes a necessary condition for exercising the right of withdrawal. The products must not have been damaged and/or altered.

The Buyer may exercise the right of withdrawal by explicitly communicating his decision to withdraw from the contract or by using the appropriate form which can be downloaded here. The communication or the form must be sent by email to the following address hello@italyonmytable.com. The communication or form must contain: purchase order number and date; delivery date; name and address of the Buyer; indication of contact details (email and telephone number): article code for which you intend to exercise the withdrawal.

The right of withdrawal applies to the Product purchased in its entirety; therefore, if the Product is made up of several components or parts, the right of withdrawal cannot be exercised only on part of the Product purchased.

In accordance with Legislative Decree, 06.09.2005, n. 206 (Consumer Code), once the notice of withdrawal has been received, Italy on my Table will send the Buyer instructions for carrying out the return shipment. In fact, the Purchaser must arrange to ship, using a carrier of his choice and at his own expense, within 14 working days from the date of communication of the withdrawal, the purchased products, accompanied by any accessories, suitably packed in their original packaging, or in equivalent as long as they are suitable for shipment by courier. Only after returning the product and only after verifying that the previous formalities have been fulfilled will the Seller refund the sums paid by the Buyer within 14 days from the day on which it received the declaration of withdrawal. The refund amount will be communicated by e-mail and credited through the same payment method used by the Buyer. The Seller may withhold the refund until he has received the products or until the Buyer has demonstrated that he has sent back the goods, depending on which situation occurs first.

6.2 Right of withdrawal – Purchase of Services
The conditions of withdrawal relating to the services purchased through the Site are indicated in the individual vouchers relating to the services themselves.

7. Obligations and Responsibilities of the Buyer

The Buyer who acts as a consumer (i.e. is a natural person and acts for purposes unrelated to any entrepreneurial, professional, commercial or craft activity carried out) is invited to familiarize himself with the articles 48-59 of Legislative Decree, 06.09.2005, n. 206 (Consumer Code), viewable here.

The Buyer guarantees the correctness and completeness of the credentials provided at the time of registration and is responsible for all operations carried out using his credentials. The registration credentials are in fact strictly personal and must not be transferred to third parties.

The Buyer undertakes not to use the Site and/or related Services for purposes that are illegal or not contemplated in these General Conditions. The Buyer may not use the Site or related Services in such a way as to damage or otherwise impair the Site or interfere with the use and enjoyment of the Site and related Services by other users.

8. Obligations and Responsibilities of the Seller

The Seller undertakes to respect these General Conditions of Sale, as well as the Special Conditions which represent their implementation.

The Seller therefore undertakes to provide Italy on my Table with all the information requested and necessary for the creation of the Virtual Showcase, including data relating to the company and individual products, as specified by the contract and by art. 49 of the Legislative Decree, 06.09.2005, n. 206 (Consumer Code).

In particular, the Seller undertakes to communicate to Italy on my Table, so that it can make them available to Buyers on the Virtual Showcase, the following information:

a) name and surname or denomination, including tax code and VAT number;

b) the total price of the goods or services inclusive of taxes or, if the nature of the goods or services makes it impossible to reasonably calculate the price in advance, the methods for calculating the price.

With reference to the food products offered for sale, both pre-packaged and loose, pursuant to EU Reg. n.1169/2011, the Seller must clearly indicate:

• name of the food;

• list of ingredients;

• allergens;

• quantity of certain ingredients or categories of ingredients, the so-called SQUID;

• net quantity;

• particular storage conditions and/or conditions of use;

• name or company name and address of any third party operator that produces the food;

• the place of origin;

• instructions for use, for cases where their omission would make it difficult to use the food adequately;

• for beverages containing more than 1.2% alcohol by volume, the actual alcoholic strength by volume;

• nutritional declaration.

Only the Minimum Conservation Term or the expiry date and the lot number must be communicated at the time of delivery. For foods containing meat or fish, the freezing date must also be indicated.

The Seller undertakes to guarantee the truthfulness and completeness of the information provided and to promptly notify Italy on my Table of any changes.

The Seller assumes all responsibility relating to the products it sells through the Site.

The seller undertakes to ship the products that conform to those described, in compliance with the times and methods agreed with Italy on my Table and with the courier used for the shipment.

The Seller undertakes not to contact the buyers registered on Italy on my Table by any means with the exception of those provided by the Site itself.

9. Obligations and Responsibilities of Italy on my Table

Italy on my Table allows Sellers to sell their products on the Platform. In each Virtual Showcase the Seller is identified and any special conditions of sale applied by this are specified. As manager of the Platform, Italy on my Table facilitates the transactions that take place on the Site, but is not part of the sale contract of the goods sold by the Sellers. Italy on my Table therefore remains extraneous to this contract, which exists exclusively between the Buyer and the Seller.

Italy on my Table assumes no responsibility for the sales contract and its correct execution, and does not act in any way as an agent of the Seller. The Seller is solely responsible for the sale of the products and for the management of disputes with the Buyer.

Italy on my Table undertakes to guarantee the correct functioning of the Site and access to the relative services. Italy on my Table undertakes to correct all errors present in the description of the products offered on the Site, in the shortest possible time, starting from the notification of the same.

Italy on my Table is not responsible in case of damages deriving from the use of the product improperly and/or not in accordance with the instructions provided by the Seller as well as in case of damages deriving from unforeseeable circumstances or force majeure. Italy on my Table disclaims any responsibility for the information provided/acquired directly from individual producers.

Italy on my Table is not responsible for the correct execution of the transport contract and for any disservices caused by the couriers in charge of shipping products purchased through the Site.

Italy on my Table is not responsible for loss of revenues, profits, data or for any other indirect damage of any nature deriving from or in any case connected to the contracts subject to the General Conditions.

Italy on my Table is not responsible for any damages deriving from the inaccessibility to the Services deriving from problems connected to the network, to the providers or to telephone and/or telematic connections of which it has no control, to the failure and/or defective functioning of the Buyers’ electronic equipment and Sellers or suppliers of both.

Italy on my Table is not responsible for content created or published on third party sites with which the Site has a hyperlink (“link”).

Italy on my Table does not allow the sale of products to minors. If you are under 18, you can only use Italy on my Table with the involvement of a parent or guardian.

10. Service Interruptions

Italy on my Table reserves the right to temporarily suspend, without any prior communication, the operation of the Site for the time strictly necessary for the necessary and/or appropriate technical interventions to improve the quality of the Platform.

Italy on my Table may, at any time, interrupt the operation of the Site if there are justified reasons, in this case notifying the users.

11. Assistance

In case of need, the Seller and the Buyer can contact Italy on my Table’s customer service at the email address hello@italyonmytable.com. Italy on my Table undertakes to take charge of requests no later than 24 hours after sending the report, but does not guarantee complete satisfaction.

12. Applicable Law and Jurisdiction

These General Conditions are governed by Italian law. For any dispute concerning the General Conditions and the use of the Site, the Court of Florence will have exclusive jurisdiction.
